If only certain members of the whānau (for example, not all of the siblings of mum and dad) are vesting their interests into the whānau trust, then name each of the persons vesting their interest in clause 1.2. 2.
Usual land consents, such as building consents are still required.
The failure to do so is a breach of the duty to be active. 3. While the Trust Land and Trust Property is to be held and used for the benefit of the Beneficial Owners, the Beneficial Owners are not the legal owners and they have no right (legal or otherwise) to instruct the Trustees how to manage and deal with Trust Land and Trust Property.
If those entitled to succeed do wish to vest the deceased’s interests in a whānau trust, please complete and attach to this application form 23 of the Māori Land Court Rules 2011.
