I now turn to consider in detail the five propositions and the various
recommendations made in the Panel’s report.
Proposition 1: Utilisation of Māori land should be able to be determined by a
majority of engaged owners
The difficulty with proposition 1 is its underlying premise that there are significant
impediments in the Act to the engaged owners utilising their land, and that a remedy
is therefore needed.
However, the sale of an incorporation’s
land can be carried out only under very stringent rules.
1. The Court may, if it considers it is in the interests of the owners to do so, make an
order incorporating as a Māori incorporation the owners of any one or more areas
of Māori freehold land, of which at least one area is owned for a legal estate in fee
simple by two or more owners (whether any such owner is entitled beneficially or
as trustee).
