Fourth And one of the funnier issues that it has thrown up for improvement, involves the appellations chosen for land blocks. Judges and Registrars past, have tended to default to surveyors over the names of newly created titles following partitions, consolidations, amalgamations or aggregations of Māori land.
Please note that you and any potential trustees and committee of management members nominated do not have any authority to act as a trust or corporation until your application has been approved by a judge or registrar. If your trust application is considered simple and uncontested, it can be handled by a registrar and will not require a formal court sitting.
When making disclosure, the judge should issue a minute through the Registrar to
counsel for all parties.
The judge should ensure that the minute contains sufficient information, without
unnecessary detail, to enable the parties to decide whether to make a recusal
application.
Clarke v Karaitiana [2011] NZCA 154 The Māori Land Court had ordered the Registrar to convene a meeting of owners of Tauhara Middle 15 to be held in September 2008 to elect trustees, having previously found that the then-trustees had committed breaches of trust sufficient to warrant removal.
