The changes to the existing Practice Note were made following a review undertaken by Judge
Warren, with helpful input from lawyers who regularly appear in our Court.
The MLC deals with applications for new trusts,
replacement trustees, variations to trusts, reviews of trusts
and formal complaints, and receives trust reports and
financial accounts.
The Tribunal concluded, after
an exhaustive review of the evidence, that the
‘gift’ was understood by Horonuku Te Heu Heu
to be an offer of a partnership with the Queen
as a joint trustee and custodian of the peaks.

Fifth The project has also highlighted the need for the Māori Land Court to be more proactive in its identification and review of defunct trusts and incorporations due to circumstances such as the death of key trustee or management committee members.
Where a determination or order has already been made by a Registrar, affected persons may also apply
to the court to seek a review of that determination or order. A review must be lodged within 20 working
days after the determination or order is made or, at the satisfaction of a Judge, within a longer period.
The reform options proposed in the paper deal with every stage of the decision making process. The review also assesses how the primary legislation interfaces with other key statutes, and the respective roles central and local government and private groups should play in the provision and management of cemeteries.
