The reforms enacted in the Burial and Cremation Act 1964 retained this basic structure but further entrenched the role of local authorities by extinguishing the right of other entities, such as trusts, to open new public cemeteries.
For Te Kooti Whenua Māori this is a time of uncertainty. We await confirmation of the details and programme for the Government’s reviewof Te Ture Whenua Māori Act, and so now is not the time for comment from the judiciary.
‘Mandatory’ duties must be performed by the trustee and cannot
be changed or avoided by the terms of the trust (the trust order).
These include the duties to know the terms of the trust, to act
in accordance with the terms of the trust, to act honestly and in
good faith, and to act for the benefit of beneficiaries of the trust.
