‘Mandatory’ duties must be performed by the trustee and cannot
be changed or avoided by the terms of the trust (the trust order).
These include the duties to know the terms of the trust, to act
in accordance with the terms of the trust, to act honestly and in
good faith, and to act for the benefit of beneficiaries of the trust.
Of the districts,
Waiariki received the largest share of new applica-
tions, with a total of 1,427 or 27 per cent of all new
applications received nationally.
This produced some pleasing results
in both spaces with an increase in new applications to Court in the earlier part of the reporting
year and the closure of some of our older applications.
