Applications to be decided without notice
Under rule 6.6 of the Māori Land Court Rules 2011, the following applications may be decided without notice and
without formal hearing.
In his classic book Māori Land Tenure
(1977) Sir Hugh Kawharu wrote that the system
of Māori land tenure created by the Native Lands
Act of 1865 was an ‘engine of destruction for
any tribe’s tenure of land, anywhere’ (p 15).
(c) To buy any land or interest in land, shares or assets whatsoever whether by way of
lease, purchase, exchange or otherwise and to acquire, sell, hire or otherwise deal in
vehicles, shares, plant, chattels or equipment.
This class of records also includes information related to making changes to land title through the
sale of Māori land, transfer of shares in Māori land between owners or to new shareholders,
alienation of Māori land by lease or license, including the licensing of timber, flax and mineral
rights.
(c) To buy any land or interest in land, shares or assets whatsoever whether by way
of lease purchase exchange or otherwise AND to acquire, sell, hire or otherwise
deal in vehicles, shares, plant, chattels or equipment.
