Share transfers can be arranged directly with the Māori incorporation or by an order of the MLC. However, the MLC only deals with Māori incorporation share transfers where successions or trusts are concerned.

Exceptions include: • a succession to further interests where there has been previous succession to the deceased person • vesting of lands in a minor who has turned 20 (provided that all appropriate documentary evidence is filed with the application).

Another important part of the Court’s work was making succession orders. If an owner died, his or her heirs had to apply to be entered in the Court titles in the place of the deceased.

The “exceptional initiatives” (as I term them) that do require Court orders are sales, long-term leases, change of status, title reconstruction and improvement, and occupation orders.

This is in case an appeal is lodged against the judge’s decision. The order will be written up in the Court title records if it affects land, and sent to every person who has to act on it, for example, to the Māori trustee if they’ve been ordered to pay money they’re holding, or a Māori incorporation5 if the order affects shares in that incorporation.
