Succession with no living descendants
Succession with a living husband, wife, or partner Māori freehold land can be owned by one owner or several owners and in some cases, there might be hundreds of owners in one block or title of land.
Why make this change?
Succession to Māori land interests can be complex for whānau
and for whāngai, and Māori land is often owned by members
of different whānau (with different views on whāngai
succession).
At 2025 Chief Judge’s MB 373-390 (4 February 2025) the Court made orders amending a successionorder to Teone Karepe I or Hoani Karepe at 32 T 117-119 (30 May 1972) and cancelling a successionorder to Porokuru Te Kiwi at 155 ROT MB 234 (30 November 1970).
This is in
case an appeal is lodged against the judge’s decision.
The order will be written up in the Court title records if it
affects land, and sent to every person who has to act on it,
for example, to the Māori trustee if they’ve been ordered to
pay money they’re holding, or a Māori incorporation5 if the
order affects shares in that incorporation.
