Trustees are appointed by the Māori Land Court under the jurisdiction set out in s 222 of Te Ture Whenua Māori Act 1993. In making appointments two crucial criteria must be considered.
Any benefit derived from the trust are used to fund Māori Community Purposes (mostly charitable) as defined by section 218 of Te Ture Whenua Act 1993.

I am very conscious from personal experience of the potential difficulties in forming a whānau trust. I have experienced those difficulties notwithstanding the fact that I was a practising lawyer and familiar with the workings of Te Ture Whenua Māori Act.
