Trustees are appointed by the Māori Land Court under the jurisdiction set out in s 222 of Te Ture Whenua Māori Act 1993. In making appointments two crucial criteria must be considered.
If the landowner does not take part or the review turns into a dispute, the water service provider can appeal to the Māori Land Court for a decision under section 166(4)(b) of the Local Government (Water Services) Act 2025 .
The MLC operates under the provisions of Te Ture Whenua
Māori Act 1993 (‘the Act’).
Trustees1 are bound by Te Ture Whenua Māori Act and the
Trusts Act 2019.
