1 Māori Land Update – Ngā Āhuatanga o te whenua June 2015 | Pipiri 2015 This update is issued by the Office of the Chief Registrar, Māori Land Court | Te Kooti Whenua Māori as part of the ongoing efforts to help inform and assist owners, organisations and government agencies about the characteristics of Māori Customary and Māori Freehold Land.

There are two main pieces of legislation to consider: the Trusts Act 2019 and the Te Ture Whenua Māori Act 1993 .
Trustees are appointed by the Māori Land Court under the jurisdiction set out in s 222 of Te Ture Whenua Māori Act 1993. In making appointments two crucial criteria must be considered.

I am very conscious from personal experience of the potential difficulties in forming a whānau trust. I have experienced those difficulties notwithstanding the fact that I was a practising lawyer and familiar with the workings of Te Ture Whenua Māori Act.
