Where more than one of the trustees of that trust
are in attendance at the meeting of the Trust they must inform the Trustees which of them
is to exercise the vote of that Trust.
‘Mandatory’ duties must be performed by the trustee and cannot
be changed or avoided by the terms of the trust (the trust order).
These include the duties to know the terms of the trust, to act
in accordance with the terms of the trust, to act honestly and in
good faith, and to act for the benefit of beneficiaries of the trust.
Accordingly, whilst all the beneficiaries of the respective whānau trusts are also beneficiaries of the ahu whenua trust, there is no election of trustees at an ahu whenua trust AGM.
