If the problems cannot be resolved, the landowners
can apply to the Māori Land Court to:
• review the terms, operation, or other aspect of thetrust
• add, replace, or remove trustees
• investigate thetrust
• enforce the terms of thetrust
• vary the terms of thetrust
• terminate thetrust.
Much will depend on the nature of thetrust’s business and the ability, experience and knowledge of nominees in areas relevant to thetrust’s activities.
When you submit an application, you’ll need to include information about thetrust and trustees. The Court will review:
day-to-day management of thetrust
financial management of thetrust
documentation of thetrust, and
the terms of thetrust.

As a trustee you need to know:
what is being administered by thetrust (any land or other assets of thetrust)
the terms of trust (your powers and responsibilities under thetrust order)
all the issues affecting thetrust.
Whenua Māori held by a Māori land trust
3. Where the title to the land is vested in a Māori land trust (e.g. an Ahu Whenua Trust or a
Whānau Trust) the trustees can approve a mortgage against the land subject to any
restrictions in thetrust order (ss 147 and 150A of the Act)
Use this form to create an Ahu Whenua Trust (a land trust) by vesting one or more land blocks in trustees to
manage, as set out in a trust deed/order on behalf of the beneficial owner(s).
