Much has been achieved by the project for Māori land owners, their whanau and hapu by giving greater certainty to title issues. The project has proven, simply by the volume of work completed and by the number of title anomalies uncovered, that both title systems were in a parlous and unsatisfactory state.
I managed a team of lawyers who looked after council’s property, commercial and construction legal work. We were involved in a number of large complex capital projects including the Art Gallery redevelopment, the Aotea Square redevelopment, and the Victoria Park Tunnel.
Its subsequent efforts to make good the loss were found to be ‘few, extremely dilatory, and largely ineffectual’. 9 The Crown accepted that its failure to complete the transfer of lands under SILNA was a breach of the principles of the Treaty of Waitangi and agreed to provide redress. 10 The Ngāi Tahu Report provided a basis for settlement negotiations between the Crown and Ngāi Tahu, eventually leading to a Deed of Settlement in 1997, and the Ngāi Tahu Claims Settlement Act of 1998....
So we are dealing with multiple owners averaging 85 owners per title – the lowest 10% averaging 1 owner to each title, and the highest 10%, averaging 629 owners in each title.
Are there problems with those titles? Is the concern that the Court registry
maintains title records in addition to Land Information New Zealand maintaining the
legal title?
