Fifth The project has also highlighted the need for the Māori Land Court to be more proactive in its identification and review of defunct trusts and incorporations due to circumstances such as the death of key trustee or management committee members.
Having made contact with the trustees of various ahu whenua trusts and the administrators of incorporations we now regularly receive correspondence from those entities.
The order will then be written up in the Court title records if it affects land, and will be sent to any party who has to act on it, for example the Māori trustee if the Māori trustee has been ordered to pay money he/she is holding, or a Māori incorporation if the order affects shares in that incorporation.

Trustees may act by majority pursuant to section 227 of the Act. 1.11 Each Trustee must use reasonable endeavours to: (a) provide each ahu whenua trust or Māori incorporation in which the Trust holds interests with current contact details for the Trust; and (b) procure that any dividends or other benefits to which the Trust is entitled from each ahu whenua trust or Māori incorporation in which the Trust holds interests are paid to the Trust. 11 SCHEDULE 2...
The minimum number of trustees for a reservation is two people (unless the trustee is a body corporate 7, such as a Māori trust board or a Māori incorporation). A trustee does not have to be an owner in the land.
