If one owner dies, the other joint tenant(s) automatically succeed to the interest that the deceased joint tenant held.
The Act now clarifies that Māori Land Court judges will follow the tikanga of the hapū or iwi associated with the land being succeeded to when deciding whether whāngai can succeed to a land interest.

It was “good to walk on the land and then go back to the kura” where there was discussion about finalising the application, including agreement that the appellation on the title would be ‘Aorere’, and who would act as interim agents for the owners.
The determination is required under the terms set out in Clause 15.6.2 of the Ngāi Tahu Deed of Settlement where the determination is decided by the Court as though the lands were Māori lands and in accordance with section 109 Te Ture Whenua Māori Act 1993 as though the deceased left no will.
