The interests of a child When the successor is a child at the time the Māori Land Court makes the succession order, the Court can also appoint a kaitiaki 19 trustee to act for the child until he or she reaches 20 years of age or marries, whichever occurs sooner.

Examples of what could be considered ‘simple’ trust matters include: • forming a whānau trust for a single owner’s interests or shares; or • terminating a kaitiaki trust for a minor when the person reaches 20 years of age; or • appointing a trustee to a whānau trust.

A further complication is that section 338(12) provides that the trustees of a Māori reservation may, with the consent of the Court, grant a lease or occupation licence of a reservation for a term not exceeding 14 years (including any term or terms of renewal).
