DISPUTESRESOLUTION SERVICE
The end to end process facilitated by the Māori
Land Court which covers the application, initial
engagement, mediation and actioning of any
mediation outcomes.
Conflict of interest generally
Judges should recuse themselves wherever they have personal knowledge of disputed
facts in proceedings, or wherever they have a personal view concerning a party or
witness of disputed fact in the litigation.
One of the interesting sessions was on alternative disputeresolution. The thread of discussions from presenters and conference attendees is that arbitration is the preferred form of disputeresolution in many overseas jurisdictions.
In that situation an Alternative DisputeResolution process had been agreed, that process was
required, and it was undertaken with findings ultimately made.
The diagram below represents
this kaupapa.

In the case of a tie, the resolution is not passed. When a resolution is passed,
the acts and proceedings that follow will be valid and of good effect as if all trustees agreed.
After the judge, registrar, or mediator makes a decision, you will receive the court minutes and orders which will also be documented in the court record. If your application was for disputeresolution, only the order will become a part of the record.
