What can be done, for example, for owners who wish to form governance structures so they can get a lease of their land to utilise it, but have difficulty notifying the owners to inform them of the proposals as required by section 215 of Te Ture Whenua Māori Act?
The funding is for clean-up of sediment & debris, where mahi has already been completed (either by owners or by contractors) and for any similar mahi to be completed in the future. Our Act provides various safeguards to ensure that Māori land may only be transferred by court order following an application to succeed, gift, or sell to the PCA.
Parts of common law and the law of equity continue to be relevant to trusts. Trusts still need to have regard to provisions for trusts in Te Ture Whenua Māori Act 1993.
