When one adds to the mix the underlying principles of Te Ture Whenua Māori Act 1993 – namely of land retention and land utilisation, in effect two competing principles – then the challenges facing Māori land owners and the Māori Land Court can be quite difficult.
From 1 July 2025 , Māori Land Court fees increase by 3.65% . This increase is part of a wider change across all courts and tribunals in Aotearoa, New Zealand.
Charging orders – water services charges In certain situations, Māori landowners may have to pay for water services. If an owner of Māori freehold land in multiple ownership has paid more than their share of water services changes, they can apply to the Māori Land Court for a “charging order” to recover the excess amount paid.
The way whenua was taken care of and how Māori lived on the land changed with the introduction of laws to allow for settler ownership.
