Te Tumu Paeroa and Community Governance Aotearoa have partnered to create a series of governing videos designed to enhance the knowledge and skills as Māori trustees.
• In the unlikely event that no one is entitled to succeed, the
Court can determine who should succeed and, if necessary,
create a trust for the deceased’s interests.
These provisions also apply to an occupation order as if it
were a beneficial interest in Māori land, provided the person
owns a beneficial interest in the land to which the occupation
order applies and the Court is satisfied the person should
succeed to the occupation order.

By doing this, your whānau members’ wishes about their land can be taken into account. This application will determine who is entitled to receive the land interests and the judge/registrar will provide an order transferring the interests to them.
If both parties agree on an outcome at mediation, we will send you the 'Terms of the Resolution', which are sent to the Court to create an order. If not, there are still steps we can take to help resolve the dispute.
