Share transfers can be arranged directly with the Māori
incorporation or by an order of the MLC. However, the MLC
only deals with Māori incorporation share transfers where
successions or trusts are concerned.
DECLARATION
I/We* the applicant(s) declare that—
(a) the facts of the application as stated are true and correct; and
(b) the persons entitled to succeed are correctly listed in this application; and
(c) there are no disputes as to succession or issues to be settled before an order can be made; and
(d) it is desired that an order be made without formal hearing and without notice.
I went on to discover however that at the time those succession applications were made, various Māori land interests had not been identified by the Court and were not included in the 1967 orders.
The changes to the existing Practice Note were made following a review undertaken by Judge
Warren, with helpful input from lawyers who regularly appear in our Court.
