The process is the same to set up each type of trust
(except kaitiaki trusts) – the owners first need to have a meeting
at which they:
• agree to set up the trust
• agree which blocks of land or shares should be included in
the trust
• agree to the terms of the draft trust order8 which sets out the
trustees’ powers, rights and obligations
• nominate trustees
• take accurate minutes.

The working list of potential owners was updated at a sitting of the Māori Land Court in Te
Waipounamu on 26 April 2022, minute book 76 Te Waipounamu 246-311. The list was
amended on 18 August 2022, minute book 78 Te Waipounamu MB 158-162.
They can also provide access to certain locations on the property, such as power poles and pylons. For example, a local council could be granted an easement to access and maintain water and sewerage pipes buried on your land, or a power company might apply to maintain power lines across your property.

An interest in an estate that becomes fully effective only when the life interest ends (often referred to as an interest in expectation). For example, a life interest may be awarded by the Court in favour of a surviving partner of a person who hold an interest in Māori land.
Obviously, the bigger the house the bigger the area you need, so a tiny home, for example, might need fewer than 300sqm. The local authority for your area may have rules about the size of the lot that you will need to check out.
