Charging orders – for refunds of water services charges In certain situations, Māori landowners may have to pay for water services. If an owner of Māori freehold land with many owners has paid more than their share of water services charges, they can apply to the Māori Land Court for a ‘charging order’ under section 99 to recover the excess amount paid.
As the report discusses, this has been a difficult process and has led to delays that have affected landowners and other Court users. We are committed to ensuring that results in this area improve, and this will be documented over forthcoming annual reports of the Court.
