The Māori Land Court cannot make
succession orders if the estate of the
deceased includes:
• general land (except for property held
jointly, like a joint family home, where the
partners are joint tenants 11)
• cash over $11,000 held by a bank or an
insurance company
• significant company shares,
unless the estate is under formal
administration (see Footnote 4, below, for an
explanation of formal administration).

preserve the kin groups, the Act restricts
the type of people to whom land can be sold
or gifted.
