Notably Chief Justice Elias, as she then was, stated in her dissenting judgement in Takamore v Clarke2 that “Maori custom according to tikanga is therefore part of the values of the New Zealand common law”. The Trick, as Justice Joe Williams’ says in relation to what he refers to as the the1st law (Tikanga Māori) and the 2nd law (Western Concepts) in Aotearoa, NZ is that we need to find a way for the 1st and 2nd laws to co-exist in the same space.

She is the fifth judge to be appointed as Chairperson of the Waitangi Tribunal, following Chief Judge Kenneth Gillanders Scott, Tā Justice Taihakurei Durie, Tā Justice Joe Williams and Chief Judge Wilson Isaac. Chief Judge Fox was appointed as a Māori Land Court judge on 1 October 2000, and shortly thereafter was appointed as the Presiding Officer of the Waitangi Tribunal’s Central North Island district inquiry in 2001.
