And speaking of the Supreme Court, it would be remiss of me not to acknowledge the recent appointment of Justice Joe Williams to the Supreme Court bench. He is the first Maori to be appointed to our highest court.
Notably Chief Justice Elias, as she then was, stated in her dissenting judgement in Takamore v Clarke2 that “Maori custom according to tikanga is therefore part of the values of the New Zealand common law”. The Trick, as Justice Joe Williams’ says in relation to what he refers to as the the1st law (Tikanga Māori) and the 2nd law (Western Concepts) in Aotearoa, NZ is that we need to find a way for the 1st and 2nd laws to co-exist in the same space.
