The
underlying legal theory is referred to today as
‘Crown pre-emption’, and was reflected in Article
2 of the Treaty of Waitangi, local ordinances, and
government land purchasing practice.
Those
people are called successors 2 and the
process is called succession.
Successors are then entitled to make
decisions about the use of that land for
their benefit and for the benefit of future
generations.

transfers of whole blocks of Māori land,

Use of vesting orders
Except when Māori land 2 is vested 3 in a
Māori incorporation 4, Māori land shares can
only be transferred by a vesting order 5 made
by the Māori Land Court.
