The drafters of the Act clearly understood the dynamics of Māori land and Māori land owners. Accordingly, under the Act the engaged owners presently make decisions about their land through the legal structures of trusts and incorporations.

Trustees are appointed by the Māori Land Court under the jurisdiction set out in s 222 of Te Ture Whenua Māori Act 1993.
They will also be able to vote on whether they want to receive the land back as Māori or General land, and how that land will be held.
Former Chief Māori Land Court Judge, who then became a Justice of the High Court, ET Durie provided the following analyses of the nature of Māori rights to land; Maori see themselves not as masters of the environment but as members of it.

This judgment is a significant milestone in the Māori Land Court and for Māori landowners. As the first fully bilingual judgment issued in its history, it signals the enhancement of te reo Māori in the Court.
