As for incorporations, the Act provides that every Māori incorporation holds the land
and assets “on trust” for the incorporated owners in proportion to their several
interests in the land (s 250(4)).

Te Kooti Whenua Māori – MāoriLand Court (MLC) is the
New Zealand Court that hears matters relating to Māoriland.
Changes also strengthen the protections for Māoriland. For example, when whenua is
changed from Māori customary land to Māori freehold land, the interests of the owners
will not be individualised.
Any final terms of trust are subject to confirmation by the MāoriLand Court in accordance
with sections 214 or 244 of Te Ture Whenua Māori Act 1993.

The Court has made a succession order and additional interests of the deceased person in Māori freehold land have been
located.
If an owner with MāoriLandinterests is deceased, and a succession has not previously been dealt with by the Court or a
Registrar, you can use this form to seek a determination from the Court as to those persons entitled to a deceased’s
MāoriLandinterests and an order transferring the interests to those entitled.

Register of interest and annual declaration
Māori incorporations must establish and maintain an interests
register for the Māoriland held by the incorporation.
Succession is the legal transfer of interests or shares in Māoriland from a person who has passed away to the people who
are legally entitled to own those interests.
