The duty to be active includes the requirement that a Trustee apply to the Māori Land Court for directions without delay when they notice that one or more of the other Trustees has or is going to commit a breach of trust.
This trust order is drafted to allow the trustees to purchase land, but not to sell it. That is because most Māori trusts focus on retaining land.
