12. Where the title to whenua Māori is held directly by the owners (i.e. there is no
administration structure such as a trust or incorporation in place over the land) a mortgage
has to be approved by every owner on the title (ss 147 and 150C of the Act).
- The Crown is not bound by tikanga per se, but tikanga may give rise to legally enforceable
