The alienee is not a member of the preferrred classes of alienees and a first right of refusal is to be given to the
preferred classes of alienees in accordance with rule 11.5.
A person may be disqualified from becoming a member if they are:
subject to an order appointing a manager under section 31 of the Protection of Personal and Property Rights Act 1998 ; or a trustee corporation managing the persons' property under section 32 or 33 of this Act
an undischarged bankrupt, or
convicted of crimes punishable by imprisonment for a period of six months or more, unless they have served the sentence or have otherwise suffered the penalty.
We have many of our people who are shareholders in multiply-owned land wanting to hold governance positions. And rightly so; it is their whenua. However, many have little or no governance experience and many lack the capability to take on the roles.
