Access to Māori land was generally considered when the title of the land was originally issued and in many cases:

there may have already been a public or private roadway servicing the land, or
a right of way to access land, across a neighbouring property, may have been put in place.
The mediator is also to record the terms of the resolution reached at mediation and report them to the Judge or Registrar who referred the issue/s to the mediator. The beneficiaries can take a case to the MLC
or the High Court. The Court regards any breach of trust as
a very serious matter, and if trustees are found to be at fault,
they can expect to pay for any losses that they have caused.
The Court may, on considering such notice, arrange for the application to be
set down for formal hearing or rehearing as the case may be.
