Every trustee must keep a copy of the trust deed (trust order) and any variations made to it. At least one trustee must hold other core trust documents such as records of the trust’s property, records of trustee decisions, and accounting records and financial statements.

Before 6 February 2021 A beneficiary of a whānau trust is not able to apply for an occupation order to use trust land for housing purposes. From 6 February 2021 The Māori Land Court can grant an occupation order to a beneficiary of a whānau trust.
The Court cannot make Court orders 5 to set the land aside as a Māori reservation.
