The order will be written up in the Court title records if it affects land, and sent to every person who has to act on it, for example, to the Māori trustee if they’ve been ordered to pay money they’re holding, or a Māori incorporation5 if the order affects shares in that incorporation.

The Court regards any breach of trust as a very serious matter, and if trustees are found to be at fault, they can expect to pay for any losses that they have caused. The MLC is able to remove trustees if it is satisfied that the trustee has lost the capacity to act as a trustee or that their removal supports the proper function of the trust.

In Pātaka Whenua, you can find information about your whenua, search the court record, make an application or enquiry online and pay the application filing fee. And you can do that at any time of the day or night from wherever you are in the world.
You will need to ask what information they need from you to pay the money to you. For example, you may need to provide your bank account details and an IRD number.
The MLC may determine who pays any costs associated with the inquiry. The applicant must also give a copy of the application to each trustee.
