Of the approximately 2.3 million ownership interests in Māori land, anecdotal evidence indicates that about half of these interests are held by deceased persons; many land interests are owned by the same person under multiple names; and many owners live far from their land and, in some cases, do not know they are owners of Māori land at all.
This should be done by the trustee or the person the trust was created for, when they’re able to do so.
Trustees may be held personally liable, jointly and severally, for any losses a trust may sustain and for other breaches of trust.
Apart from the legal process outlined above, once a person is buried on that land important and weighty cultural considerations come into play.
This means issues of a personal and sensitive nature to whānau may be discussed in a public court hearing.
This seemed to be an invitation for personal reflection on my career and aspirations for our people, so that is how I have approached my task this morning.
