Vote on whether to form an ahu whenua trust, or alternative options for managing the whenua in future.
The main priorities for the Court now are first, to remedy errors in the lists, using s 86 of TTWMA, and second, to update the list of successors based on previous and new evidence, the latter of which requires hearings to be held so evidence can be heard. An application form based on the existing form for successions has been modified for the purposes of SILNA determinations, and individual applications are linked to a central file to ensure consistency.
Here an individual can form the trust and appoint trustees and the shareholding, which maybe across many blocks, is held for the uri of that individual down through the generations.
Authority and Instruction form: A prescribed form which authorises and instructs a
lawyer to take certain actions on behalf of the landowners such as registering a
mortgage.
An election was then held in October 2011 and the owners voted to replace all of the existing trustees. New trustees were finally appointed in November 2011.
