If a trustee has been removed by the Court for cause under s 240 of the Act, should that be a relevant consideration when assessing a candidate’s suitability for appointment?
These changes include making it easier for landowners to establish Māori incorporations,
and provisions for removing a trustee or a member of a committee of management of an
incorporation have been updated.
This includes who are beneficiaries of the trust, the
name and contact details of the trustees, and information about
the appointment or removal of trustees.
As for the second recommendation, the Panel appears to be promoting a reduction
in the Court’s role in the appointment and removal of trustees, though this is not
made entirely clear in the report.
