The Benefits Notwithstanding the very lengthy amount of time it took to form the whānau trust and the ongoing administration, what have been the benefits of forming the whānau trust?
Examples of what could be considered ‘simple’ trust matters include: • forming a whānau trust for a single owner’s interests or shares; or • terminating a kaitiaki trust for a minor when the person reaches 20 years of age; or • appointing a trustee to a whānau trust.

No person shall be disqualified from being appointed trustee or from holding office as a trustee or representative of the trust because they: (a) are employed as a servant or officer of the trust; or (b) are interested or concerned in any contract made by the trustees; or (c) are a beneficial owner of the trust.

Any benefit derived from the trust are used to fund Māori Community Purposes (mostly charitable) as defined by section 218 of Te Ture Whenua Act 1993.
