Changes in place from 6 February 2021
In August 2020, the Government passed targeted changes to the Act with Te Ture Whenua
Māori (Succession, Dispute Resolution, and Related Matters) Amendment Act 2020.
...trustees may appoint subcommittees to oversee any aspect of Marae business.
6.4 At the time of appointing a subcommittee, the trustees shall set out in writing the terms of reference.
6.5 At least one trustee shall sit on any subcommittee.
7. Dispute resolution
7.1 If disputes or disagreements arise about:
7.1.1 Conflicts of interest;
7.1.2 Allegations about trustee misconduct;
7.1.3 The performance of a trustees or trustees;
7.1.4 The practice of tikanga and/or kawa at the mara...
In the interim, the judiciary will continue to have the discretion to set applications down for special hearings to progress the many applications that are waiting for resolution. Our Court is working hard to ensure that matters are dealt with as swiftly as possible.
One of the interesting sessions was on alternative dispute resolution. The thread of discussions from presenters and conference attendees is that arbitration is the preferred form of dispute resolution in many overseas jurisdictions.
The decisions of any meeting don’t bind
the Court either – the minutes and resolutions are merely
evidence of the proceedings and the resolutions reached.
In those cases, a mortgage can be approved by:
(a) A resolution carried at a meeting of assembled owners per Part 9 of the Act; or
(b) Constituting a trust or incorporation over the land and using the administration
structure to approve the mortgage as set out above.
