If any family members don’t consent, their interests must not be included, and they’ll receive their shares personally. Where a family member isn’t included and doesn’t contribute shares to the trust, it’s important the whānau trust order doesn’t inadvertently include that person as a beneficiary.

With shares held by individuals becoming increasingly fractionated but shares held in whānau trusts being relatively stable, I foresee a time when these whānau trusts will be major shareholders in trusts and incorporations.
if there are not quite enough shares to partition out the area needed, the partitioning owner may pay the difference in cash as assessed by the valuer. on the other hand, the partitioner may own more than enough shares and may decide to leave some shares in the residue block with the other owners.
