Setting up an incorporation
Previously, landowners seeking to form an incorporation
need to show that owners with not less than 15 percent of
shares in the Māori land consented to the proposal.
Now, landowners seeking to form an incorporation need to
show there is a sufficient degree of support for the proposal,
and that sufficient notice of the proposal has been given.
You will also need to provide evidence you have notified
beneficiaries or owners and have any consents to the
application that are required.
When we roll out our new technology system, you will be
able to make this application online via the Māori Land Court
website.
A further complication is that section 338(12) provides that the trustees of a Māori reservation may, with the consent of the Court, grant a lease or occupation licence of a reservation for a term not exceeding 14 years (including any term or terms of renewal).
