(c) The Occupier shall leave the Site clean and tidy, and clear of rubbish and
possessions at the End Date.
13. Succession to the Occupation Order
(a) The parties acknowledge that this occupation order is capable of being
succeeded to in accordance with the wishes of the Occupier, save that any such
succession must be consistent with the Act.
The PCA includes:
children of an owner or their descendants
whanaunga of an owner associated with the land in accordance with tikanga Māori
other beneficial owners who are members of the hapū associated with the land
trustees of anyone above
descendants of any former owner who is or was a member of the hapū associated with the land
a person who has been legally adopted under the provisions of the Adoption Act 1955
a person who has been adopted in accordance with Māor...
The judge or registrar may issue an order giving the whāngai child the right to occupy a family home on the land, or to receive all or part of any income from the land interest, or both. Succession involving a legally adopted child is not the same as succession involving a whāngai child.
Usually successions were fairly
routine, but matters could get complicated
in the case of adoptions, which often created
intricate legal and factual problems.

(n) To form companies and to subscribe for and acquire shares in companies and to
adopt and change their constitutions to further the interests of the trust.
Try all the different names they might be known by including
nicknames, married names, adopted, whāngai Māori names, and names that may
have been spelt incorrectly.
