In the Māori Land Court and the Māori Appellate Court, the judges are able to apply to the hearing such rules of marae kawa as they consider appropriate (s 66 of Te Ture Whenua Māori Act 1993). In the Waitangi Tribunal, the panel can have regard to and adopt such aspects of marae kawa as the Tribunal thinks appropriate.
We await confirmation of the details and programme for the Government’s review of Te Ture Whenua Māori Act, and so now is not the time for comment from the judiciary.

Requests to appoint a mediator from beyond the list require approval from the Pae Matua o Te Kooti Whenua Māori (Director of the Māori Land Court) before they can proceed.
