See Erceg v Erceg [2016] NZSC 135, [2017] 1 NZLR 310 at [2], where the Supreme Court emphasised the constitutional significance of open justice and media reporting of court proceedings. In the Māori Land Court and the Māori Appellate Court, the judges are able to apply to the hearing such rules of marae kawa as they consider appropriate (s 66 of Te Ture Whenua Māori Act 1993).
Its work is guided by the Te Ture Whenua Māori Act 1993, which recognises Māori land as taonga tuku iho – a precious heritage and treasure passed down through generations.

Requests to appoint a mediator from beyond the list require approval from the Pae Matua o Te Kooti Whenua Māori (Director of the Māori Land Court) before they can proceed.
We await confirmation of the details and programme for the Government’s review of Te Ture Whenua Māori Act, and so now is not the time for comment from the judiciary.
