...In the Muriwhenua Land Report the Waitangi Tribunal found that when the Treaty was signed Māori
expected that their customary law would continue because of assurances from British representatives.4
The Tribunal found that the remarks of Tamati Waka Nene (“you must preserve our customs”) were
typical of Māori opinion.5 Such an expectation was consistent with common law principles that applied
to colonies.
