I argued that the information that was put before the Court at that time was incorrect, on the basis that the Judges who heard those applications were not aware that there was an earlier succession application in 1967 where it was clearly intended that all interests were to be vested in one sibling. The above information is a very truncated summary of what was involved.
However, the Act still provided that adoption orders could be made in the Māori Land Court.

This would align the Act with the rating charging order provisions in Part 4 of the Local Government (Rating) Act 2002, which permit the compulsory vesting of Māori land in a receiver or trustees where there is a rating debt.

When the court reviews the trust, it may: (a) make directions to the trustees; (b) confirm the trust order without variation; (c) vary the trust order; or (d) make an order terminating the trust.

Where that land is vested in a trust or an incorporation, such an order will only be made with the consent of the trust or management committee, and may be made for a specified period.
Note that this right does not extend to a mortgagee sale – see paragraphs 22-23 above. Trust Order: A Court order setting out the terms under which trustees hold and manage land or other assets vested in them by the owners of the land or assets.
You and the other people in the case will each be sent a copy. Orders about what is to happen next will be signed by the judge or a deputy registrar, and sealed with the Court’s official seal.
