Trust not a separate legal entity
1.2 If the Trust is to enter into any legally binding agreements, arrangements or
understandings with one or more third parties, it is the Trustees who are legally bound on
behalf of the Trust.
In its legal use, this means physical or mental disablement that, in the opinion of
the Court, results in a person lacking, wholly or partly, the competence to manage
their affairs in relation to their property.

With shares held by individuals becoming increasingly fractionated but shares held in whānautrusts being relatively stable, I foresee a time when these whānautrusts will be major shareholders in trusts and incorporations.
